Abstract

This study looks at the Criminal DNA Database system and the submission requirements. DNA testing results have become a relevant and reliable source of evidence in criminal proceedings since 1988. Law enforcement uses a few different types of sophisticated DNA testing methods to enhance the reliability of DNA testing as a solid source of evidence. At this point in time, the United States as a whole lacks the uniformity of DNA submission requirements. Each state identifies specific crime requirements for the DNA database. Some states solely require violent felony offenders submit DNA samples for the database as opposed to other states which require all violent, non-violent and some misdemeanor offenders submit DNA samples. This study examines the general public’s perceptions of those convicted of misdemeanor offenses who are then required to submit a DNA sample for the database, and will become classified in the same group as convicted felons. In this study, I found the view of the general public to be negative towards the inclusion of DNA profiles for those convicted of misdemeanors.
